Important: These Terms and Conditions constitute a legally binding agreement between you and Roof360. Please read them carefully before using our services or facilities.

1. Introduction and Acceptance

Welcome to Roof360, Dubai's premier luxury rooftop pool experience located at 69b 12C St - Jumeirah - Jumeirah 1 - Dubai - UAE. These Terms and Conditions ("Terms") govern your use of our facilities, services, and website. By making a booking, visiting our facility, or using our services in any capacity, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not use our services or visit our facility. These Terms apply to all visitors, guests, and users of our services, regardless of how you access or use our facilities.

2. Definitions

For the purposes of these Terms, the following definitions apply:

  • "Roof360," "we," "us," or "our" refers to the luxury rooftop pool facility and its operators
  • "Guest" or "you" refers to any individual using our facilities or services
  • "Facility" refers to the rooftop pool area and all associated amenities
  • "Services" includes all amenities, activities, and experiences provided by Roof360
  • "Booking" refers to any reservation made for our services
  • "Website" refers to our online platform and any associated digital services

3. Facility Access and Booking

Access to Roof360 is by reservation only. All guests must have a valid booking confirmation to enter the facility. We reserve the right to refuse entry to anyone without a valid booking or who fails to meet our entry requirements.

3.1 Booking Requirements

To make a booking, you must:

  • Be at least 21 years of age or accompanied by a parent or legal guardian
  • Provide accurate and complete information during the booking process
  • Make payment in full at the time of booking
  • Present valid identification upon arrival
  • Comply with our dress code and facility rules

3.2 Booking Modifications and Cancellations

Booking modifications and cancellations are subject to our Refund Policy. We recommend reviewing our cancellation terms before making a reservation. Changes to bookings are subject to availability and may incur additional charges.

4. Facility Rules and Conduct

To ensure the safety, comfort, and enjoyment of all guests, the following rules must be observed at all times:

4.1 General Conduct

  • Respect other guests and maintain appropriate noise levels
  • Follow all posted signs and instructions from staff members
  • No smoking except in designated areas
  • No outside food or beverages permitted
  • Children under 18 must be supervised by an adult at all times
  • No glass containers in pool areas
  • Appropriate swimwear required in pool areas
  • No diving or running in pool areas

4.2 Dress Code

Roof360 maintains a sophisticated dress code to preserve the luxury atmosphere of our facility. Appropriate attire includes:

  • Smart casual or resort wear
  • Appropriate swimwear in pool areas
  • Covered footwear in dining areas
  • No offensive or inappropriate clothing or accessories

4.3 Photography and Privacy

While we encourage guests to capture memories of their experience, we ask that you respect the privacy of other guests. Commercial photography or filming requires prior written approval from management.

5. Health and Safety

The health and safety of our guests is our top priority. By using our facilities, you acknowledge and accept certain inherent risks associated with rooftop and aquatic activities.

5.1 Swimming and Pool Safety

  • Swimming is at your own risk
  • Non-swimmers should exercise extreme caution
  • Children must be supervised at all times
  • Pool depth varies - exercise caution when entering
  • No lifeguard on duty - swim at your own risk
  • Report any injuries or incidents to staff immediately

5.2 Medical Conditions

Guests with medical conditions, including but not limited to heart conditions, pregnancy, or mobility limitations, should consult with their healthcare provider before using our facilities. Please inform our staff of any relevant medical conditions upon arrival.

5.3 Weather Conditions

Our facility is located on a high-rise rooftop and may be subject to weather-related closures for safety reasons. We reserve the right to close or restrict access to certain areas due to weather conditions.

6. Liability and Insurance

By using our facilities, you acknowledge and agree to the following liability terms:

6.1 Assumption of Risk

You voluntarily assume all risks associated with your use of our facilities, including but not limited to risks of injury, illness, property damage, or death that may result from your activities at Roof360.

6.2 Limitation of Liability

To the maximum extent permitted by law, Roof360, its owners, operators, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our facilities or services.

6.3 Indemnification

You agree to indemnify and hold harmless Roof360 from any claims, damages, losses, or expenses (including legal fees) arising from your use of our facilities or any violation of these Terms.

7. Personal Property

Roof360 is not responsible for lost, stolen, or damaged personal property. We recommend that guests:

  • Secure valuables in provided lockers where available
  • Avoid bringing unnecessary valuable items
  • Report any lost items to staff immediately
  • Understand that lost and found items are held for a limited time

8. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Roof360 or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.

8.1 User-Generated Content

By posting photos or content on social media featuring our facility, you grant Roof360 a non-exclusive, royalty-free license to use such content for marketing and promotional purposes.

9. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our privacy practices as outlined in our Privacy Policy.

10. Payment Terms

All bookings require payment in full at the time of reservation. We accept major credit cards, debit cards, and other approved payment methods. All prices are in UAE Dirhams (AED) and include applicable taxes unless otherwise stated.

10.1 Additional Charges

Additional charges may apply for:

  • Premium services or upgrades
  • Food and beverage purchases
  • Damage to facility property
  • Late cancellation fees
  • Special event surcharges

11. Force Majeure

Roof360 shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, civil unrest, pandemic restrictions, or other emergencies.

12. Termination and Removal

We reserve the right to terminate your access to our facilities and remove you from the premises for:

  • Violation of these Terms or facility rules
  • Disruptive or inappropriate behavior
  • Intoxication or substance abuse
  • Failure to pay required fees
  • Safety concerns
  • Any reason deemed necessary by management

No refunds will be provided for removal due to violation of Terms or facility rules.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

14. Dispute Resolution

We encourage guests to contact us directly to resolve any concerns or disputes. If a dispute cannot be resolved through direct communication, we may pursue alternative dispute resolution methods, including mediation or arbitration, as appropriate under UAE law.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website and will be effective immediately upon posting. Your continued use of our services after any modifications constitutes acceptance of the updated Terms.

For significant changes that may affect your rights or obligations, we will make reasonable efforts to provide advance notice through our website or other appropriate means.

17. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Roof360 regarding your use of our services. These Terms supersede all prior agreements, understandings, and communications, whether written or oral.
